I would never suggest that someone handle their case directly with an insurance company on their own. It’s very important that they consult with a personal injury attorney because if you are dealing with an insurance company, you are dealing with an adjuster, and that adjuster has handled thousands if not, tens of thousands of cases and they know how to handle that case and how to adjust that case to benefit their employer, the insurance company, that adjuster is not there to help you, that adjuster is there on the phone with you trying to get information to help their case, not help your case, and the way they help their case is by minimizing the exposure that insurance company has. What that means in layman’s terms is they limit the amount of money they pay you. Their goal is pay you as little as possible for your injuries. I never recommend that an individual attempt to handle their personal injury case directly with an insurance company, on their own. In fact, I recommend that you should never ever try to handle your personal injury case yourself and you should always consult with a personal injury attorney immediately after you are injured in an accident due to no fault of your own.
The following different insurance adjusters may attempt to call you after you’ve been injured in a personal injury accident:
- Insurance adjuster for the at-fault party or tortfeasor;
- Insurance adjuster for any other party involved;
- Insurance adjuster for your insurance company in the case of an automobile accident.
I always recommend that you do not speak with any insurance company representative, other than to report the accident, or provide them with a verbal or written statement until you have had the opportunity to consult with a personal injury attorney first. A trained personal injury attorney knows how to present your claim in the best light possible to the insurance company. Additionally, a trained personal injury knows what information to provide, what to say and what not to say to the insurance adjuster handling your claim.
When you’re dealing with an insurance company, you’re dealing with a well-trained insurance adjuster whose job it is to protect the interest of their employer, the insurance company. If the insurance adjuster calls you after the accident you need to be aware that the adjustor on the phone with you is trying to get information to help their employer, the insurance company or their insured who is responsible for the accident. They’re not there to try and help your case and are usually attempting to minimize the amount of exposure that insurance company has in your case. What that means, in layman’s terms, is they limit the amount of money that they pay you and your loved ones for your economic damages, out of pocket damages, injuries and other damages you’ve suffered such as loss of enjoyment of life.
Generally speaking, an insurance adjuster’s goal is to pay you as little money as possible for your injuries. If you hire a personal injury attorney, their goal is to get you as much money as possible for your injuries.
