Most personal injury cases do not go to trial. Most personal injury cases settle when the demand is submitted to the insurance company. If your case does not settle at that point and it is required that your attorney file a lawsuit in court on your behalf, most of those cases even settle before trial.

Circuit court uses what is called mediation. Most cases when they go to mediation, that is when both sides sit down with the help of a mediator and solve your case. If your case does in fact go to mediation, over 80% of those cases settle at mediation with the help of a mediator. If your case is resolved at mediation, it will not go to trial before a jury.
