What is a letter of protection?

Often times people injured in an automobile accident or other personal injury case in Miami or Fort Lauderdale do not have insurance or the ability to pay for the medical treatment they need to treat their injuries. By that, I mean more specifically, they don’t have automobile insurance, health insurance, and are not a recipient of Medicare or Medicaid, or have any other means by which to pay for the medical treatment related to the injuries sustained in their accident. But without this medically necessary treatment the injury victim will not recover from their injuries as they otherwise would and will be unable to properly present their personal injury case to the insurance company of the at fault party.

Signing Letter

When this happens many injury victims and their attorneys use what is called a “letter of protection” with a medical doctor who is willing to accept it in return for treating the injury victim. When you sign a letter of protection, your attorney will usually sign the letter of protection as well, and what that letter of protection is, is a promise to pay the doctor or medical clinic for the services received at the conclusion of your case. Whether your case goes to trial or whether it settles before trial, you have then have to pay that doctor for the medical treatment that you received as a result of your accident.

A letter of protection should be used as a last resort and should only be used if you have no other way to get the medical treatment you need. This is because the rate you will ultimately pay for the medical treatment received will be more than the amount paid by insurance companies, Medicare and/or Medicaid. Insurance companies, Medicare and Medicaid pay only a small fraction of the amount billed by medical providers in Florida due to provider agreements they sign with insurance companies as well as the Medicare and/or Medicaid fee schedules that govern what they have to pay.
