Obtaining Workers’ Compensation After Being Injured While Working as a Delivery Driver

DelDriver

Local 10 News recently reported that one man had been arrested and another remains on the loose after two pizza delivery driver workers were robbed over a recent weekend in southwest Miami-Dade. According to an arrest report, both workers were robbed in separate incidents by the same parties outside of the same vacant house.

Unfortunately, delivery drivers inherently face workplace dangers and these workers are especially prone to work-related injuries due to the nature of their job. The repeated lifting of heavy packages throughout the day as well as constant bending can lead to back and spine issues that can affect a delivery driver both now and in the future. And with any transportation-related job, auto collisions are an associated risk. The risks for delivery drivers are clear and workplace accidents, unfortunately, happen. Therefore, it is important to understand the next steps that should be undertaken following this kind of workplace injury.

I’ve Been Injured While Working as a Delivery Driver. What Should I Do?

Obtain medical attention. Regardless of how minor your injuries may seem, there are many injuries that may not produce symptoms for days or even weeks. It is imperative that you obtain a medical exam which can reveal latent injuries as well as serve as documentation that can later help validate the circumstances of your workplace injury.

Contact your employer. Reach out to your employer as quickly as possible to report the incident in which you were injured. Make sure that you communicate the time and date of your injury and ask for an injury report to be generated which you should request a copy of.

Document the scene. Use your smartphone to take pictures of the scene of the accident. Additionally, record the names and contact information of anyone who witnessed the accident. This is another important step in substantiating that your injuries were incurred when and where you will later assert that they did.

Contact an experienced workers’ compensation attorney. Though it may seem tempting to try to navigate the system alone, with this kind of claim especially, you need help since your injuries did not occur in a traditional workplace. Additionally, there is always the chance that your employer will try to label you as an independent contractor, meaning you would be unable to recover workers’ compensation benefits under Florida’s workers’ compensation statute. If you try to pursue your claim alone, you may reduce or even eliminate your entitlement to the benefits you could have received.

Allow Us to Take the Wheel.

If you have been injured on the job as a delivery driver, understand that you deserve full compensation for your injuries – and don’t assume that you are not entitled to workers’ compensation benefits just because your employer has labeled you an independent contractor. As quickly as possible, you should obtain competent legal help with your claim. An experienced workers’ compensation attorney can help you get the compensation you need to recover from your injuries and get back on the road. The Miami workers’ compensation attorneys at Payer & Associates have years of experience helping injured workers obtain workers’ compensation benefits.
