How do I file a complaint against an insurance company in the state of Florida?
Every state, and Florida is no exception, has a department in the government that regulates insurance companies and oversees the way that their handle their insurance claims. In Florida that agency is called the Florida Office of Insurance Regulation and is located at 200 East Gaines Street, Tallahassee, FL 32399 (850) 413-3140.
The types of insurance claims that are frequently filed in Florida with insurance companies and/or insurance carriers are:
- Workers’ Compensation Insurance Claims
- Automobile Liability Claims
- First Party Automobile Insurance Claims – Property Damage
- First Party Automobile Insurance Claims – No-Fault, Personal Injury Protection or PIP
- Homeowners Insurance Claims – General
- Homeowners Insurance Claims – Fire Damage
- Homeowners Insurance Claims – Flood Damage
- Homeowners Insurance Claims – Theft Losses
- Hurricane or Wind Insurance Claims
- Life Insurance Claims
- Renters’ Insurance Claims
- Disability Insurance Claims
- Medical Liability Claims
If you feel like you’ve been mistreated by an insurance company during the claims process, you can contact the Florida Office of Insurance Regulation and file a complaint against the insurance company. In Florida, you can file what’s called a civil remedy letter if you feel like you’ve been mistreated by an insurance company and what that does is it puts that insurance company on notice through the Florida Office of Insurance Regulation that one of their policyholders or a third party in an automobile accident or in a slip-and-fall accident feels like they have been mistreated by that insurance company and the Florida Office of Insurance Regulation will then contact that insurance company and try to resolve whatever issue you have.
If they are unable to satisfactorily resolve your complaints I suggest that you consult with a personal injury lawyer in order to represent you because they have the experience and knowledge necessary to file that complaint with the Florida Office of Insurance Regulation in order to get the results you need. Additionally, a personal injury attorney may be able to represent you in a law suit against the first party insurance company or the party at fault.
